Bobby Online: Seu Guia para Conquistar a Carteira de Motorista Britânica™

Este Acordo de Curso Online ("Acordo") é firmado entre a Bobby Auto Escola ("Provedor") e o participante pagante ("Participante"). Ao se inscrever e acessar o curso online da Bobby Auto Escola ("Curso"), o Participante concorda com os seguintes termos e condições:

1. Cláusulas de Pagamento

1.1 Taxas do Curso: O Participante concorda em pagar as taxas do curso conforme descrito no site da Bobby Auto Escola no momento da inscrição. Todas as taxas não são reembolsáveis, exceto conforme previsto neste Acordo.

1.2 Método de Pagamento: Os pagamentos devem ser feitos através dos métodos de pagamento autorizados especificados no site do Provedor. O Participante concorda em fornecer informações de faturamento precisas e completas.

1.3 Pagamentos Atrasados: A falha em realizar pagamentos pontuais pode resultar na suspensão ou rescisão do acesso ao Curso até que todas as taxas pendentes sejam pagas integralmente.

2. Prazo e Rescisão

2.1 Prazo: Este Acordo começa na data de inscrição do Participante no Curso e o acesso é válido por 6 meses, começando a contar a partir da data em que o pagamento foi recebido e confirmado. O acesso cessará após 6 meses, independentemente de o Participante ter concluído o Curso.

2.2 Rescisão pelo Participante: O Participante pode rescindir este Acordo a qualquer momento, fornecendo aviso prévio por escrito ao Provedor. Nenhum reembolso será emitido em caso de rescisão pelo Participante ou por qualquer outro motivo.

2.3 Rescisão pelo Provedor: O Provedor reserva-se o direito de rescindir este Acordo e o acesso do Participante ao Curso se o Participante violar qualquer termo deste Acordo ou se envolver em conduta que o Provedor considere prejudicial ao Curso ou a outros participantes.

2.4 Efeito da Rescisão: Após o término do período de 6 meses, o Participante não terá mais acesso aos materiais do Curso. Para recuperar o acesso ao Curso após os 6 meses, o Participante precisará comprar o Curso novamente.

3. Escopo dos Serviços

3.1 Conteúdo do Curso: O Provedor entregará o conteúdo do Curso, que inclui vídeos instrutivos projetados para ajudar o Participante a se preparar para o teste prático de direção do Reino Unido.

3.2 Acesso: O Participante terá acesso ao conteúdo do Curso através da plataforma online do Provedor pelo período especificado na descrição do Curso.

3.3 Suporte: O Provedor oferecerá suporte por e-mail ou fóruns online para resolver quaisquer dúvidas ou problemas relacionados ao conteúdo do Curso.

4. Proteções de Responsabilidade

4.1 Sem Garantias: O Provedor não garante que o Participante passará no teste prático de direção do Reino Unido como resultado de fazer o Curso. O Participante reconhece que passar no teste depende de seus próprios esforços e habilidades.

4.2 Limitação de Responsabilidade: A responsabilidade do Provedor por quaisquer reivindicações decorrentes deste Acordo ou relacionadas a ele ou ao Curso é limitada ao valor das taxas pagas pelo Participante. O Provedor não é responsável por quaisquer danos indiretos, incidentais ou consequenciais.

5. Propriedade Intelectual

5.1 Materiais do Curso: Todos os materiais do Curso, incluindo, mas não se limitando a vídeos, textos, gráficos e software, são propriedade intelectual do Provedor e são protegidos pelas leis de propriedade intelectual aplicáveis.

5.2 Licença: O Participante recebe uma licença limitada, intransferível e exclusiva para acessar e usar os materiais do Curso apenas para uso pessoal, não comercial e não pode ser compartilhada com terceiros.

5.3 Restrições: O Participante não pode copiar, distribuir, modificar ou criar obras derivadas dos materiais do Curso sem o consentimento prévio por escrito do Provedor.

6. Confidencialidade

6.1 Informações Confidenciais: O Participante concorda em manter todas as informações relacionadas ao Curso, incluindo, mas não se limitando ao conteúdo do Curso e informações de outros participantes, confidenciais e não divulgar tais informações a terceiros.

6.2 Violação de Confidencialidade: Qualquer violação de confidencialidade pode resultar na rescisão imediata do acesso ao Curso e em ação legal para recuperar danos.

7. Disposições Gerais

7.1 Alterações: O Provedor reserva-se o direito de alterar este Acordo a qualquer momento. Quaisquer alterações serão efetivas imediatamente após notificação ao Participante.

7.2 Lei Aplicável: Este Acordo será regido e interpretado de acordo com as leis do Reino Unido.

7.3 Acordo Integral: Este Acordo constitui o acordo integral entre o Participante e o Provedor em relação ao Curso e substitui todas as comunicações e propostas anteriores ou contemporâneas.

Ao se inscrever no Curso, o Participante reconhece que leu, entendeu e concorda em cumprir os termos e condições deste Acordo.

Bobby Online: Your Guide to Earning a UK Driving Licence™

This Online Course Agreement ("Agreement") is made and entered into by and between Bobby Auto Escola ("Provider") and the paying participant ("Participant"). By enrolling in and accessing the Bobby Auto Escola online training course ("Course"), the Participant agrees to the following terms and conditions:

1. Payment Clauses

1.1 Course Fees: The Participant agrees to pay the applicable course fees as outlined on the Bobby Auto Escola website at the time of enrolment. All fees are non-refundable except as provided in this Agreement.

1.2 Payment Method: Payments must be made through the authorised payment methods specified on the Provider's website. The Participant agrees to provide accurate and complete billing information.

1.3 Late Payments: Failure to make timely payments may result in suspension or termination of access to the Course until all outstanding fees are paid in full.

2. Term and Termination

2.1 Term: This Agreement begins on the date of the Participant's enrolment in the Course and access is valid for 6 months, starting from the date payment has been received and confirmed. Access will cease after 6 months regardless of whether the Participant has completed the Course.

2.2 Termination by Participant: The Participant may terminate this Agreement at any time by providing written notice to the Provider. No refunds will be issued upon termination by the Participant or for any other reason.

2.3 Termination by Provider: The Provider reserves the right to terminate this Agreement and the Participant's access to the Course if the Participant violates any terms of this Agreement or engages in conduct that the Provider deems detrimental to the Course or other participants.

2.4 Effect of Termination: Upon the end of the 6-month period, the Participant will no longer have access to the Course materials. To regain access to the Course after the 6 months, the Participant will need to repurchase the Course.

3. Scope of Services

3.1 Course Content: The Provider will deliver the Course content, which includes instructional videos designed to help the Participant prepare for the UK driving practical test.

3.2 Access: The Participant will have access to the Course content through the Provider's online platform for the duration specified in the Course description.

3.3 Support: The Provider will offer support through email or online forums to address any questions or issues related to the Course content.

4. Liability Protections

4.1 No Guarantees: The Provider does not guarantee that the Participant will pass the UK driving practical test as a result of taking the Course. The Participant acknowledges that passing the test depends on their own efforts and abilities.

4.2 Limitation of Liability: The Provider's liability for any claims arising out of or related to this Agreement or the Course is limited to the amount of fees paid by the Participant. The Provider is not liable for any indirect, incidental, or consequential damages.

5. Intellectual Property Ownership

5.1 Course Materials: All Course materials, including but not limited to videos, texts, graphics, and software, are the intellectual property of the Provider and are protected by applicable intellectual property laws.

5.2 Licence: The Participant is granted a limited, non-transferable, exclusive licence to access and use the Course materials for personal, non-commercial use only and the access cannot be shared with third-parties.

5.3 Restrictions: The Participant may not copy, distribute, modify, or create derivative works from the Course materials without the Provider's prior written consent.

6. Confidentiality

6.1 Confidential Information: The Participant agrees to keep all information related to the Course, including but not limited to Course content and other participants' information, confidential and not to disclose such information to any third party.

6.2 Breach of Confidentiality: Any breach of confidentiality may result in immediate termination of access to the Course and legal action to recover damages.

7. Miscellaneous

7.1 Amendments: The Provider reserves the right to amend this Agreement at any time. Any amendments will be effective immediately upon notice to the Participant.

7.2 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.

7.3 Entire Agreement: This Agreement constitutes the entire agreement between the Participant and the Provider with respect to the Course and supersedes all prior or contemporaneous communications and proposals.

By enrolling in the Course, the Participant acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Agreement.
